RENTAL AGREEMENT & USE RESTRICTIONS

This Agreement is made and entered into by The Gathering Place, hereinafter “TGP”, and the undersigned Renter, ______________________. TGP and Renter agree to the following terms and conditions for the rental of all or portions of property located at 730 U.S. Highway 8, Turtle Lake, Wisconsin:

Large Banquet Hall: Maximum Capacity 299        

[Renter is responsible to make sure the capacity is not exceeded.]

1.       Rental Date(s): ______________________

2.       Use: Renter will be entitled to use the premises on the rental date(s) between the hours of ______ a.m./p.m. and ______ a.m./p.m. Renter and all invitees, employees and caterers must exit the parking area by 1:30 a.m. or 30 minutes after the event, whichever is earlier.

3.       Rent: Renter agrees to pay for the use of the premises described above, the amount of $____________, plus sales tax if applicable. (If exempt, sales tax exemption form must be provided with deposit.)

4.       Deposit: Total rent as a deposit is due and payable on the signing of this agreement. Payment of deposit/rent secures the premises for the date(s) of the event. In the event of cancellation 180 days or less before the scheduled event, the deposit is non-refundable. If canceled more than 180 days in advance of the rental date, one half of the rent/deposit shall be refunded.

5.       Purpose: Renter is using the facilities for the purpose of ________________________, and no other purpose.

6.       Prohibited: Smoking is prohibited inside the building. Smoking shall be allowed outdoors only. No animals are allowed, except as may be required by law. Renter shall not use, or allow to be used, confetti, rice, bird seed or silly string indoors. This facility holds a state liquor license, no alcoholic beverage(s) may be brought in by you or your guests.

7.       Damage: In addition to the rent/deposit, Renter is responsible for all damages to the premises of personal property which result from or occur during the Renter’s use of the premises except as may be caused by TGP or its employees. If candles are used a damage deposit of $50 cash is required to cover any possible wax damage.

8.       Impossibility of Performance: TGP shall be released from its obligation to perform under this agreement in the event that the property cannot be used because of any event beyond the control of TGP, such as, but not limited too, condemnation, flood, wind or weather, public disturbance, governmental restrictions, fire, smoke, loss or interruption or utility services or other similar events. In such event, Renter shall receive a refund of the rent/deposit, which shall be the limit of liability for TGP. There is no liability by TGP for any consequential damages.

9.       Alcohol: Alcohol shall be sold, served and provided by the licensed facility (TGP), and as limited by State Law. Renter is responsible for appropriate use and consumption of alcohol at the event by Renter or any of Renter’s invitees, and shall assume liability for any damages caused by such alcohol consumption. No other alcohol allowed. Specific bar arrangements to be made at least 7 days in advance of event date.

10.   Decorations: Renter may decorate the property for said event as may be agreed by TGP. All decorations must be removed immediately upon conclusion of Renter’s event. Decorations may be attached only to the existing hooks. Nails, screws, pins, tape, staples and other similar items are prohibited. No open-flamed candles are allowed. Covered candles may be used provided that all such candles are located in the center of each table.If candles are used a damage deposit of $50 cash is required to cover any possible wax damage.

11.   Deliveries: Scheduling of deliveries is the responsibility of Renter. Renter must make arrangements to meet with individual vendors, including florists, caterers, bakers, or food suppliers at the premises, unless previously arranged by Renters with TGP.

12.   Music: Renter is responsible to supply any music, which must be kept at a reasonable volume at all times. Music must be terminated no later than 12:45 a.m. Music and entertainment is allowed only within the rented banquet hall or meeting room(s).

13.   Cleanup: Renter is responsible for collecting all garbage and placing the same in bags, and depositing the same in dumpers located outside the facility. All recyclable materials shall be put in provided recyclable containers.

14.   Security: Renter is responsible to provide their own security personnel, if any.

15.   Personal Items: TGP is not responsible for damaged, lost or stolen personal belongings of Renter’s invitees, employees or vendors. All such personal belongings shall be removed by Renter upon termination of the event. TGP is not responsible for storage or protection of any property left behind after the event.

16.   Common Areas: Renter shall have the non-exclusive use or common areas of the property such as parking facilities and restrooms.

17.   TGP Employees: TGP shall provide the following labor for the Renter’s event:

a.       One licensed bartender included with full day rental of large hall, and ______ additional bartender(s) for _____ hour(s) each at the rate of $______/hr.

b.      ______ waiters/waitresses at the rate of $______/hr. for ______ hour(s).

c.       Other: ______________________ at the rate of $______/hr.

18.   Food/Catering: Renter is responsible for all actions of caterer, and shall hold TGP harmless, and pay for any damages cause by caterer. TGP does not provide food or catering services. Renter is responsible for full replacement cost of any missing or damaged items.

Any kitchen fees or personnel fees or personnel fees must be paid at least 7 days prior to event date.
 
19.   Assignment: This agreement is for use of the property by Renter. No rights may be assigned.

20.   Indemnity: Renter shall indemnify and save harmless TGP against any loss, damage or expense from actual or claimed death or injury to any person, or actual or claimed damage to property, including loss of use, which actually or allegedly results from or arises from use of the premises by Renters or Renter’s guests, invitees, employees, or caterers, unless the same has been caused solely by the negligence of TGP. Indemnity includes costs of defense, including reasonable attorney’s fees.

21.   Landlord/Tenant: Nothing construed in this rental agreement shall be considered a landlord/tenant relationship within the meaning of Chapter 704 of the Wisconsin Statutes.

22.   Venue: Polk County, Wisconsin shall be the venue for any action concerning this agreement. Wisconsin Law shall apply.
